Sands Host Your Own Starlight Walk – Terms and Conditions

The following Terms and Conditions apply to participants who register to take part in Sands’ Host Your Own Starlight Walk and fundraise in support of Sands.

Registration

• Sands reserves the right to refuse any application at its absolute discretion without providing a reason.
• By registering for Host Your Own Starlight Walk, you agree to these Terms and Conditions.
• Anyone creating their own fundraising page must be aged 16 or over. By accepting these Terms and Conditions, you confirm that you are aged 16 or over.
• Participants under the age of 16 must be registered and supervised by a parent, guardian or responsible adult aged 18 or over.
• To count towards your Host Your Own Starlight Walk fundraising total, your walk and fundraising activity should take place within the campaign period specified by Sands. Any fundraising pages may be archived after the campaign closes, and all funds raised will be treated as donations to Sands.
• If you wish to fundraise outside of the campaign period, please contact Sands for guidance.

Fundraising

• By registering for Host Your Own Starlight Walk, you agree to raise funds in support of Sands.
• Any suggested fundraising target communicated by Sands is voluntary unless expressly stated otherwise.
• Gift Aid is additional to any fundraising target and cannot be counted towards it.
• All funds raised as part of your Host Your Own Starlight Walk must be paid directly to Sands and must not be used for any other purpose.
• You may not use the Host Your Own Starlight Walk branding, fundraising page or event activity to raise money for any other charity or cause without the prior written consent of Sands.
• You are responsible for ensuring that all fundraising conducted in connection with your walk complies with applicable laws and fundraising regulations.

Withdrawals

• You may withdraw from Host Your Own Starlight Walk at any time by contacting Sands.
• Any money raised before withdrawal will be treated as a non-refundable donation to Sands and will support the charity's work.
• Registration for Host Your Own Starlight Walk does not guarantee receipt of any fundraising incentive, merchandise or event materials.

Conduct

• Host Your Own Starlight Walk gives you the flexibility to choose your own date, time and location.
• You are responsible for ensuring your chosen route is safe, suitable, accessible and only uses paths, roads and public spaces where you have the legal right to be present.
• If you choose to take part with an animal, including a dog, it remains your responsibility at all times.
• You are responsible for ensuring you are appropriately dressed and equipped for weather, terrain and other conditions.
• You must conduct yourself respectfully and appropriately throughout your participation and must not engage in behaviour that could reasonably be expected to:
• cause offence or distress to others;
• damage Sands' reputation;
• cause harm or injury to yourself or others; or
• breach any applicable law or regulation.
• This includes, but is not limited to, harassment, discrimination, bullying, vandalism, littering or any other unacceptable behaviour.
• Sands reserves the right to withdraw support for any participant who fails to comply with these standards.
• Sands cannot be held responsible for any misconduct, damage, loss or liability you may encounter during or as a result of your walk.

Health and Fitness

• By registering, you acknowledge that walking is a physical activity and that participation involves an element of personal risk.
• You take part entirely at your own risk.
• If you have any concerns about your health or ability to participate safely, you should seek appropriate medical advice before taking part.
• You confirm that you understand the potential physical risks involved and believe yourself capable of participating safely.
• Sands cannot be held responsible for any illness, injury or medical condition arising during or as a result of your participation.

Photography, Video and Media

• Any photographs, videos, audio recordings, stories, testimonials or quotes that you submit to Sands in connection with Host Your Own Starlight Walk may be used by Sands on its website, social media channels, publications, marketing materials and future promotional activities.
• By submitting such content, you grant Sands permission to use it for these purposes without additional compensation.
• If you would like your content removed from future use, please contact Sands and reasonable efforts will be made to do so.
• You should only submit images, videos or recordings if you have the permission of everyone featured in them, or their parent/guardian where appropriate.

Data Protection

• By registering for Host Your Own Starlight Walk, you provide Sands with personal information which will be processed in accordance with Sands' Privacy Policy.
• Sands will process your personal data in line with applicable UK data protection legislation and only retain information for as long as necessary for the purposes of administering the event and related activities.
• You have the right to request access to, correction of or deletion of your personal information in accordance with applicable data protection laws.

Legal

• You acknowledge that you are acting in a personal capacity and are not an employee, agent or representative of Sands.
• You may use Sands' name, logos and approved materials solely for promoting your Host Your Own Starlight Walk and only in accordance with any guidance provided by Sands.
• Sands reserves the right to require you to amend or stop using its name, logos or materials at any time.
• Sands shall not be liable for:
• any loss of or damage to personal possessions or equipment;
• any injury, loss, damage, cost or liability arising out of or in connection with your participation; or
• any indirect, special or consequential loss.
• By participating, you agree that any claims arising from your participation in Host Your Own Starlight Walk shall, to the fullest extent permitted by law, be your responsibility.
• Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot legally be excluded.
• Sands makes every effort to ensure that information relating to Host Your Own Starlight Walk is accurate and up to date, but accepts no responsibility for errors, omissions or actions taken in reliance on such information.
• Sands reserves the right to amend these Terms and Conditions at any time.
• These Terms and Conditions shall be governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
